Acceptance of These Terms

Welcome to the eJamin portal, a service provided and maintained by DAPAT Vista (M) Sdn Bhd (“We” or “Us” or “Our”) for the Government of Malaysia. The services provided by this portal ("the Services") are subject to the following Terms and Conditions of Services (“these Terms”).

You confirm that you have the legal capacity (including you are of legal age under Malaysian laws) and authorisation to so use and be bound. If you do not have legal capacity or authorisation or if you do not agree to these Terms: (i) you must not use this portal and the Services; and (ii) if you proceed to use this portal, you do disclaiming any rights you may have against Us and shall provide the indemnity contained in these Terms.

The Services offered to you are based on your absolute acceptance without modification of these Terms. You acknowledge that, from time to time, it may be necessary for Us to update or revise certain provisions of these Terms. By continuing to use this portal or the Services after the updates or revisions are completed, you agree and accept those updates and revisions made, and to be bound by the updated version of these Terms and confirm that you have the legal capacity and authorisation to use and be bound. You agree you do not require us to notify you personally about the changes to these Terms, this portal and Services.

Registration Obligations

In consideration for the use of the Services, you agree to register an account and provide true, accurate, current and complete information about yourself as prompted by “user profile” page and refrain from impersonating or falsely representing your affiliation with any person or entity, maintain and update the Registration Information to keep it true, accurate and current, maintain a valid contact information at all times and promptly notify Us in writing of any change to your contact information from time to time, be responsible for maintaining the confidentiality of your account and password and shall be responsible for any and all transactions by users given access to such account or password (“Your Users”) and any and all consequences of use or misuse of your account and password by you or Your Users.

Refund and Forfeiture of Bail Money

We shall have the right to process the refund or forfeit any bail money posted, as directed by the Courts of Malaysia. This right shall be exercised strictly in accordance with the instructions and orders provided by the Courts of Malaysia and any applicable laws and regulations of Malaysia including but not limited to the Financial Services Act 2013, the Islamic Financial Services Act 2013 and the Personal Data Protection Act 2010 (“Applicable Laws”).

You acknowledge and agree that:

1. Any bail money posted by you or on your behalf may be refunded or forfeited in full or in part upon us receiving instructions from the Courts of Malaysia.
2. We shall not be liable for any loss, damage, or inconvenience caused by the refund or forfeiture (in full or in part) of bail money as instructed by the Courts of Malaysia.
3. You shall comply with all conditions and requirements set forth by the Courts of Malaysia regarding the posting, handling, and disposition of bail money.

Actions not Permitted whilst using the Services

You agree that all information, data, text, photographs, graphics, messages or other materials ("Content") publicly posted to this portal by you is your sole and absolute responsibility. You are entirely responsible for all Content that you upload, post or otherwise transmit via this portal and the Services. We do not guarantee the accuracy, integrity or quality of such Content. We reserve the rights, but are not obligated, to review the Content posted via this portal and the Services. Although We prohibit the uploading of certain types of Content to the website, We cannot control the use of our Service and this portal. It is possible that images or other material may appear on this portal which are unlawful or offensive. We are not responsible for such images or material. Neither Us, Our group of companies or Our subsidiaries, affiliates, officers, agents, co-branders or other partners and employees and or servants shall be responsible and/or liable in any manner whatsoever for the appearance on this portal of such images or materials.

We may at Our discretion contact law enforcement authorities if We believe that anything unlawful is occurring or has occurred in relation to this portal. We may provide copies of any relevant images or material to the law enforcement authorities and in that connection may also give them access to any personal data that is held by Us. In registering for the Services, you agree not to use the Services to:

1. upload, post or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of anothers privacy, hateful, politically motivated, or racially, ethnically or otherwise objectionable. In this regard, you agree to comply with all requirements under Malaysian laws including but not limited to the Malaysian Communications and Multimedia Content Code (the "Code") together with all Applicable Laws and shall not provide and/or post any prohibited Content (as set out in the Content Code) nor any Content in contravention of Applicable Laws on to the eJamin portal website. 2. upload, post or otherwise transmit any Content of a third party/entity without those third parties’ or entities’ prior knowledge and consent; harm minors in any way; impersonate any person or entity;
3. upload, post or otherwise transmit any Content that you do not have a right to transmit under any Applicable Laws or under contractual or fiduciary relationships (such as insider information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements);
4. upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, unless such party’s prior written consent is first had and obtained;
5. upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation, advertising or promotion;
6. upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; interfere with or disrupt or hack into the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services;
7. intentionally or unintentionally violate any applicable local, national or international law including but not limited to the Code and any Applicable Laws;
8. "stalk" or otherwise harass another;
9. collect or store personal data about other users; and/or
10. promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals.

In addition and subject to Clause 6 below, you further agree that while using and or while preparing to use the Services, you shall not interfere with any other portal users’ use and/or enjoyment of the Services and this portal; modify, adapt, translate or reverse engineer any portion of the Services and this portal; remove any copyright, trademark or other proprietary rights and/or notices contained in or on the Services and this portal; reformat or frame any portion of the web pages that are part of the Services and this portal.

The foregoing shall not in any manner whatsoever affect or prejudice any of Our other rights as set out in these Terms including but not limited to the right to submit personal data regarding yourself that is held by Us and or copies of any posting(s) which has been uploaded by you on to this portal to law enforcement authorities, in the event We determine that any such Content and/or posting(s) is prohibited and/or is otherwise in violation of these Terms.

Financial Security and Investment

By utilizing eJamin’s services, You authorise Us to invest your deposited funds with the understanding that such investment carries no risk to the original deposit amount. We shall manage the investment in accordance with prudent investment practices to ensure the security of the your deposit and maintain transparency as well as compliance with applicable laws and regulations.

Security, Disclosure & Disclaimer

1. You must promptly notify Us of any breach of security related to this portal and the Services, including but not limited to unauthorised use of your password or account. To help ensure the security of your password or account, please sign out from your account at the end of each session.
2. Sometimes, your use of this portal and the Services may be interrupted. This could happen due to power failure, equipment malfunction, human error, software update, maintenance, repair, government order, epidemic, natural disaster, emergency, social unrest, labour conflict or any other reason. It could result in loss of, or limited, access; loss of data or customised settings; limited or no functionality; obsolete or wrong data displayed; transactions abandoned or mistakenly concluded; or other loss or inconvenience. We are not liable for such interruption.
3. The sending of information electronically is not always secure. The information which you provide through this portal and the Services or which We transfer electronically could be intercepted and used for malicious purposes.
4. We do not give any warranty (whether statutory, express or implied) on the availability, reliability or quality of hardware or internet or telecommunication services for you to use this portal and the Services; the freedom of this portal and the Services from malware; the security of information you provide through this portal and the Services; non-infringement; or fitness for a particular purpose. Your use of this portal and the Services is entirely at your own risk.

Intellectual Property Rights

You shall retain all intellectual property rights, including copyright, to the Content that you have uploaded to this portal.

You agree that We have a royalty-free, non-exclusive licence(s) in perpetuity to display, hold, modify, print, transmit, distribute or delete any of the Content that you at any time upload on to the portal. The use of such information by third parties visiting this portal is beyond Our control.

Indemnity

You agree to indemnify and hold Us, and our group of companies, subsidiaries, affiliates, officers, agents, co-branders or other partners (including any person or entity with which We have a service and or other contractual relationship, whether such relationship is evidenced in writing or otherwise), and employees and or servants, harmless from any claim or demand, including claims for legal fees, made by any third party due to or arising out of your Content, your or Your Users use of this portal and the Services, your connection to the Services, you or Your Users violation of these Terms, or you or Your Users violation of any rights of another. You agree to pay any legal fees incurred by Us due to or arising out of your Content, you or Your Users use of the portal and the Services, your connection to the Services, You or Your Users violation of these Terms, or you or Your Users violation of any rights of another.

Assignment / Successors inure

The rights, benefits and entitlements herein contained shall inure for the benefit of Us, Our successors-in-title and Our permitted assigns.

Law and Jurisdiction

These Terms and the provision of the Services by Us are governed by and shall be interpreted in accordance with Malaysian Laws. In the event of any dispute arising in relation to these Terms or in relation to the provision of the Services by Us, the Malaysian Courts will have exclusive jurisdiction over such dispute.

Non-Exclusive Relationship

The relationship between the parties under these Terms is not a partnership under the Partnership Act 1961 or an agency relationship whatsoever.

Complaints

If your claim against us is successful in any court or alternative dispute resolution forum, your remedy is limited to a refund of any excess payments made by you (if any) in connection with such claim, being our aggregate liability cap. If no fees are associated with such a claim, our aggregate liability cap is only RM100.00 for all causes of action relating to the same matter.

We may take up to 90 days after you provide complete details of your complaint through the means referred to in paragraph (a) above to resolve your complaint. You may take legal action against us in court or in alternative dispute resolution forums only if we are unable to resolve your complaint within that period. The resolution of your complaint is a full and final settlement between the parties and you waive your right to take any further action against us in the same matter in court or in alternative dispute resolution forums.

Remedies

If your claim against us is successful in any court or alternative dispute resolution forum, your remedy is limited to a refund of any excess payments made by you (if any) in connection with such claim, being our aggregate liability cap. If no fees are associated with such claim, our aggregate liability cap is only RM100.00 for all causes of action relating to the same matter.

We are not liable for any indirect, special, consequential, incidental, exemplary, punitive, or liquidated damages (including lost profits, revenues, or business opportunities) arising from your use of the App and Website, even if we have been advised of the possibility of such damages. We are not liable to your family members or friends.

Severability

If any of the provisions of these Terms arre found by any competent authority (whether judicial or quasi-judicial) to be void, illegal, invalid, prohibited or unenforceable, such provisions shall be deemed to be deleted from these Terms and the remaining provisions of these Terms shall thereafter remain in full force and effect.

Waiver

No failure to exercise or delay in exercising by Us of any claim, remedy or right under these Terms shall operate as a waiver thereof nor shall any single or partial exercise thereof preclude any other or further exercise thereof or the exercise of any other claim, remedy or right. Our waiver of your breach of these Terms shall not be construed as a waiver of any subsequent breach. Our rights and remedies under these Terms are cumulative and not exclusive of other rights or remedies provided by law.

Entire Agreement

These Terms contain the entire agreement between Us and you on the subject matter here and supersedes all prior agreements and understandings between Us and you whether written or not, including any promises by Our representatives. Except as provided under these Terms, no communication between Us and you, whether or not through Our respective representatives, shall be valid to amend these Terms or to grant any waiver to you unless formalised in writing, expressed as such an amendment or waiver and signed by a member of our senior management team specifically authorised to do so.

Termination

You may terminate your account and these Terms by following the process for account deletion. Please follow the instructions in the App and Website to properly delete your account. We may take some time to remove you from the App and Website system after the account deletion, so you may still receive communication from us until the termination process is complete. Deleting the App does not mean that your account will be automatically terminated.

Maklumat Peribadi

1. Dengan menggunakan portal ini dan Perkhidmatan, anda bersetuju untuk pengumpulan, penyimpanan, penggunaan, dan pendedahan data peribadi anda mengikut, dan bersetuju untuk terikat secara undang-undang oleh, Terma ini selagi anda mempunyai akaun di portal ini atau terus menggunakan portal ini atau Perkhidmatan. Anda harus membaca Terma ini dengan teliti sebelum meneruskan untuk menggunakan portal ini atau Perkhidmatan.
2. Selari dengan Akta Perlindungan Data Peribadi 2010 Malaysia, kami bernekad untuk memastikan bahawa data peribadi yang telah anda beri kepada kami adalah terlindung. Data peribadi itu tersulit dan terlindung oleh suatu sistem yang teguh dan bersifat lewah, yang memakai dasar keselamatan yang tegas. Kakitangan kami terlatih dengan penekanan terhadap betapa mustahaknya keperluan untuk melindungi data peribadi anda.
3. Kami mengumpul data peribadi daripada pihak kerajaan dan organisasi lain dan juga semasa interaksi anda dengan kami, termasuk semasa anda menggunakan App dan Tapak Web, semasa anda berhubung dengan kami dan semasa anda bertemu dengan wakil-wakil kami. Kami mungkin memakai kuki untuk memperoleh maklumat tentang penggunaan App dan Tapak Web oleh anda, termasuk data peribadi. Pengiklan dalam App dan Tapak Web juga mungkin memakai kuki. Kuki dimuat turun dalam peranti anda apabila anda mengunjungi sesuatu laman web atau mencapai pautan iklan dalam App dan Tapak Web. Jika anda enggan menerima kuki, anda boleh laraskan tetapan dalam peranti anda untuk menolak kuki.
4. Maklumat mengenai anda yang kami kumpul dan simpan merangkumi:
   • Maklumat tentang kunjungan anda ke laman web dan pautan dan jangka masa kunjungan itu.
   • maklumat tentang trafik web, kedudukan dan perhubungan.
   • nama, alamat tempat tinggal dan tempat kerja, nombor kad pengenalan, nombor pasport, pusat mengundi, kaitan dengan apa-apa organisasi, maklumat perhubungan, imej, akaun media sosial, identiti rakan, maklumat kad kredit dan rekod hutang, bil dan bayaran.
5. Kami boleh menzahirkan data peribadi anda kepada pihak ketiga (termasuk perbadanan berkaitan kami (menurut takrif dalam Akta Syarikat 2016 Malaysia), pembekal perkhidmatan, institusi kewangan dan kerajaan, yang mungkin berada di luar Malaysia). Pengumpulan, penyimpanan, penggunaan dan penzahiran data peribadi anda oleh kami adalah untuk tujuan-tujuan seperti berikut:
   • menghubungi anda, mengelolakan akaun anda dan melaksanakan fungsi App dan Tapak Web.
   • memperbaiki App dan Tapak Web, termasuk menyesuaikan fungsi mengikut tabiat anda.
   • menawarkan produk sesuai dengan minat anda dan aktiviti pemasaran dan promosi yang lain.
   • membekalkan maklumat kepada anda tentang fungsi-fungsi App dan Tapak Web.
   • menghasilkan laporan dan perangkaan yang menunjukkan data peribadi secara tanpa nama atau agregat.
   • mengesan penyalahgunaan, mengelak penipuan, menentusahkan kedudukan kewangan anda melalui semakan rujukan/laporan kredit dan melaksanakan semakan lain seumpamanya.
   • menjalankan kajian pasaran.
   • mematuhi kewajipan undang-undang.
   • sebagai sebahagian daripada peralihan hak milik perniagaan App dan Tapak Web.
   • menyiasat dan menyelesaikan pertikaian dan menguatkuasakan hak kami bawah Terma Ini dan undang-undang.
6. Kami menyimpan data peribadi anda (sama ada dalam pelayan milik kami atau milik pihak ketiga) sepanjang perhubungan pihak dan selepas itu, untuk selama mana perlu untuk melindungi kepentingan kami. Kami berhak memindahkan data peribadi anda ke luar Malaysia untuk analisis dan penyimpanan.
7. Anda boleh memohon untuk menyemak data peribadi anda dalam rekod kami dan untuk membetulkannya. Anda juga boleh menolak atau menarik balik izin yang telah diberikan untuk kami mengumpul, menyimpan, menggunakan atau menzahirkan data peribadi anda atau memohon supaya data peribadi anda dipadamkan daripada simpanan kami, namun jika anda berbuat demikian, App dan Tapak Web mungkin tidak dapat berfungsi untuk anda dan anda mungkin terlepas komunikasi penting daripada kami. Jika anda ingin teruskan bawah perenggan ini, sila hubungi kami melalui saluran yang dipaparkan dalam App dan Tapak Web.
8. Jika anda memberi kami data peribadi pihak ketiga termasuklah sesiapa yang tidak mempunyai keupayaan di sisi undang-undang untuk memberi izin, anda mengesahkan bahawa anda telah mendapatkan izin jelas daripada pihak ketiga itu atau anda mempunyai hak undang-undang untuk memberi kami data peribadi pihak ketiga itu. Anda juga mengesahkan bahawa anda akan bertanggung jawab secara peribadi atas tindakan mereka semasa menggunakan App dan Tapak Web. Anda juga memberi kami lepas tanggungan / tanggung rugi bawah Terma Ini.

Pemberitahuan dan Pemakluman Perkhidmatan

Sebagai pengguna berdaftar di portal ini, kami dari semasa ke semasa akan menghantar e-mel kepada anda mengenai akaun portal anda, status sistem, gangguan atau memaklumkan anda tentang ciri-ciri baru yang tersedia untuk anda.
